The <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2022-07-13\/pdf\/2022-14214.pdf\">37-page document<\/a> outlines six key areas the agency would like to address:<\/p>\n<ul>\n<li>Full up-front pricing, costs and finance disclosures<\/li>\n<li>Sales process disclosures<\/li>\n<li>Add-on product benefits<\/li>\n<li>Bait &amp; switch<\/li>\n<li>Surprise junk fees<\/li>\n<li>Record retention<\/li>\n<\/ul>\n<p>The public commentary period closes on <strong>September 12<\/strong>, at which time the agency will evaluate the responses and make a final ruling. Industry associations &#8211; including NADA &#8211; requested an extension to the 60-day review period proposal, which <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2022\/08\/ftc-declines-extend-comment-period-proposed-auto-rule-deadline-comments-sept-12\">the FTC declined<\/a>.<!--more--><\/p>\n<p>The agency says it is responding to an increase in consumer complaints since the pandemic, noting more than 100,000 consumer complaints in each of the past three years regarding new and used motor vehicle sales. To put this in perspective. if we compare the FTC\u2019s 100,000 complaints and their cited 17 million new vehicles sold each year, the number of complaints represents <span style=\"text-decoration: underline;\"><strong>less than one percent <\/strong><\/span>of all new vehicle transactions. The bulk of these complaints hinge around alleged misleading dealership practices creating an environment where consumers pay for add-on products without knowledge or consent.<\/p>\n<p>According to the FTC, the proposed rules would protect consumers and honest dealers by making the car-buying process clearer and more competitive. The proposal would also <strong>allow the Commission to recover money<\/strong> when consumers are misled or charged without their consent.<\/p>\n<p>NADA challenged the proposed rules in July, stating that the agency\u2019s justification for the rule changes is <a href=\"https:\/\/www.autonews.com\/dealers\/nada-challenges-ftc-dealer-rules-unjustified-sloppy\">\u201cwoefully inadequate\u201d<\/a>, based on sloppy, inconsistent and unsupported data. Regardless of the pushback received, the <strong>FTC seems to be moving forward<\/strong> with these rules. So what can you do now?<\/p>\n<p>While these regulations feel like the entire industry is being impacted by the actions of a few \u2018bad actor\u2019 dealerships, there are strategic efforts that upstanding, compliant dealerships can do now to make the best of this situation.<\/p>\n<h4>#1 &#8211; Get familiar with the proposal<\/h4>\n<p>This is not a situation where \u2018ignorance is bliss.\u2019 The FTC report clearly spells out the requested changes. Read the details and take a side-by-side review of the changes versus practices at your dealership.<\/p>\n<h4>#2 &#8211; Ask questions<\/h4>\n<p>If you do not speak your mind, you will not be heard.
